HSYK Başkanvekili Özbek: Yargının bu konuma düşürülmesi sıkıntı verici

ANKARA (Cumhuriyet Bürosu) - HSYK Başkanvekili Kadir Özbek, telefon dinlemelerini değerlendirirken “Yargı şu anda savunma konumundadır. Kuvvetler ayrılığı ilkesi, kuvvetler ayrılığı sistemini değerlendirdiğimizde yargının savunma konumuna düşürülmüş olması son derece sıkıntı vericidir” dedi.
Özbek, kurulun seçilmiş üyeleriyle yapılan toplantının ardından gazetecilere açıklamalarda bulundu. Seçilmiş üyelerle son günlerde gündeme gelen telefonların dinlenilmesi iddialarını görüştüklerini belirten Özbek, “Yargı şu anda savunma konumundadır. Kuvvetler ayrılığı ilkesi, kuvvetler ayrılığı sistemini değerlendirdiğimizde yargının savunma konumuna düşürülmüş olması son derece sıkıntı vericidir. Bunu, tüm yargı mensupları olarak hep beraber yaşıyoruz. Umarım ki bundan sonra yargıyla ilgili konularda son derece duyarlı ve dikkatli davranılır. Çünkü bu Türkiye’nin, sistemin geleceğiyle doğrudan bağlantılı bir durumdur” diye konuştu.

Özbek, dinleme olaylarının son zamanlarda giderek artan bir şiddetle süregeldiğini ve toplumda herkesin sade vatandaşın dahi dinlenildiği, izlendiği paranoyası yarattığına dikkat çekti. Özbek, “Fakat son zamanlarda, bu geçen günlerde Sincan Ağır Ceza Mahkemesi Başkanı ve Yargıtay savcısıyla ilgili olarak gündeme yansıyan konular, basında yer aldığı gibi kurulumuza henüz intikal etmedi. Kurulumuza disiplin yönünden intikal ettiğinde bu yolda gerekli çalışmalarımızı yapacağız, gerekli değerlendirmelerimizi sizlerle paylaşacağız” dedi.
Özbek, HSYK’nin haziran ayında, dinlemelerin hukuki dayanağının olması gerektiği ve özellikle adalet müfettişlerinin başvurusu üzerine mahkemelerce verilen dinleme kararlarının kanununa uygunluğunun yargı süzgecinden geçmesi gerektiği yönünde açıklama yapıldığını anımsatarak şu değerlendirmeyi yaptı: “Bunun, yargı süzgecinden geçirilmesinin yolu da Ceza Muhakemesi Kanunu’nun 309. maddesindeki kanun yararına bozma yoluna başvurmaktır. Burada görevli olan Adalet Bakanımızdır. Kendisi kurulun başkanıdır. Kurulun aldığı kararın bugüne kadar Yargıtay denetimine sunulmadığını öğrenmiş bulunuyoruz. Dinlemelerin sürdürüldüğünü görüyoruz. Bu işin de takipçisi olacağımızı ifade etmek istiyorum.” “Sizin dinlenildiğinize ilişkin endişeniz var mı” sorusunu yanıtlarken de Özbek, “Türkiye’de herkesin dinlenildiğinden bahsediliyor” dedi.
